Beware of Neuromarketing
Adults are taught to be skeptical. But the subconscious is like a toddler

Forget focus groups, marketing studies or even psychographics, 2009 is the year the selling juggernaut will use neuroscience and our own biology against us.

Or rather that's Buy-ology, the name of book by marketing mastermind Martin Lindstrom who recounts his findings from a massive brain-research project exploring why we buy. Appealing directly to the brain's buy impulse is called "neuromarketing," and he spent three years and $7 million, using both CT scanning and fMRI (functional magnetic resonance imaging) technology, to examine how people's brains respond to advertising and marketing ploys.

Lindstrom's findings echo those from some of the psychological strategies, but a surprising amount of the hard science shows that much of the most effective advertising is actually counterintuitive.

For example, health warnings on cigarette packs actually make people long to smoke. In Lindstrom's studies, the sight of these warnings prompted the "craving" center of the subjects' brains to light up. Apparently, there's a subliminal appeal. People love cigarettes, and anything associated with them -- even dire warnings -- will get them salivating like Pavlov's dog. That includes the colours of cigarette packages.

Excluded from the usual ad venues, tobacco companies are way ahead on the subliminal advertising path. They pay attractive businesses such as smart cocktail lounges or NASCAR competitors to adopt package colors, which triggers the craving center of the brain. Suddenly a patron in a gold and burgundy bar has an inexplicable urge to smoke. Cigarettes that feature a rugged individualist cowboy have also branched out into clothing and accessories with heartland style.

Lindstrom says this sort of subliminal advertising is actually more effective than conventional ads -- again, they can tell from the brain scans -- because it doesn't cause the consumer to put up a guard. The site of logos, brand names, or anything overtly connected with selling, such as a TV commercial, engages the conscious mind. Adults are taught to be skeptical. But the subconscious, it seems, is more like a toddler: easily seduced by anything that addresses primal emotional needs.

Sex slows sales

So what works for marketers and against you?


Sex, it turns out, doesn't sell (despite what every editor says). All that erotically charged imagery actually overwhelms the brain, which can't recall the product.

What does work is sex with emotion, particularly sex with controversy. (Or as P.T. Barnum is alleged to have said, "There's no such thing as bad publicity as long as they spell your name right.")

Suddenly the success of that 1980 ad "Nothing comes between me and my Calvins," featuring barely pubescent Brooke Shields, 15, doing her Lolita routine, makes sense. As Lindstrom recounts, the outrage was loud, relentless and memorable. The most important thing in triggering a buy is to make a product memorable, which is what happens when a buyer experiences emotion connected with a product.

For this reason, product integration -- product placement where the gizmo is integral to the plot of a TV show -- is far more effective than conventional ads, which cue the audience to be en garde. Ironically, technology that allows viewers to skip TV ads may actually do sellers a favour, as it forces them to find more effective techniques.

Successful ads create fear about personal inadequacy (for which the product is the solution) but if you stimulate the part of the brain that registers general anxieties -- such as fear of job loss -- customers are put-off.

Wire up the focus group!

The best ads offer wish-fulfilment -- if you buy these jeans, you too will look like the pretty, happy models. But those models can't be out of the consumer's league. The trick is to create an idealized image of a consumer.

For example, Abercrombie and Fitch hired better-than-average looking teenagers to don the clothes and hangout, in packs, around their stores. They looked popular and attractive to the target market, but were well within what those teens could achieve themselves as long as they had the 'rents credit card.

With their underdeveloped brains, teenagers particularly have the urge to mirror other teens, an impulse that appears to explain a lot of fads. It's better known as monkey-see, monkey-do. Primates imitate those around them due, it turns out, to some observed actions stimulating certain satisfying parts of their little chimp brains.

Now marketers can wire up a focus group and see if the fad they're selling hits those relevant grey cells. No more "throwing spaghetti at the wall and seeing what sticks," as Lindstrom puts it. Even in cases where we don't consciously want a product, this research will give marketers a hammer for hitting the wallet-opening reflex.

Resistance is futile

I wish I could promise that reading Lindstrom's analysis of his research will help you defend against neuromarketing, but the findings suggest the opposite -- soon consumers will have nowhere to hide. Well, short of actual hiding.

If you have any connection with the external world -- the shops, the media, the web, entertainment, religion -- you run the risk of being manipulated by cynical enterprises looking to separate you from your cash. Yes, that's business as usual, only now they have better tools.

Not that Lindstrom actually says that. He's more like a gleeful scientist who just discovered how to split the atom. Presumably, an editor warned him about his tone as he volunteers, at regular jarring intervals, that there's nothing frightening about neuromarketing.

(An ill-considered strategy. I found it merely fascinating until he employed the classic liar's technique of denying something before being accused. Now I suspect this is the nuclear bomb of consumer manipulation.)

I couldn’t imagine a more enjoyable and exciting birthday.

“Gush Shalom” has acceded to my wish to mark my 85th birthday not with a public celebration, as on my 80th, but with a brain-storming session devoted to the main issues concerning Israel.

At the close of the event, I was given the floor. This is what I said:

DEAR FRIENDS, DEAR PARTNERS,

I have to admit that I am moved. Throughout my long life I have not been pampered with expressions of affection. I am much more used to manifestations of hate. Therefore, please excuse me if I am a bit embarrassed.

PEOPLE ASK ME: How does it feel to be 85?

Well, it is strange. After all, only yesterday I was 42, the youngest member of the Knesset. I don’t feel any older or wiser than I did then.

85 is (in the old Hebrew way of numbering by letters) PH. PH can mean “poh”, here - and yes, I am here and fully intend to remain here for a while to come – first, because I enjoy it, and second, because I still have some things to finish.

PH can also mean peh, mouth – the mouth that enables me to voice my thoughts. I would like to take this opportunity to share with you some of the thoughts that are occupying my mind today.

What is special about 85-year-olds in Israel? First of all, we are the generation that founded the state. As such – I feel – we bear an additional responsibility for what is happening here. If our state is not what we imagined it should be – it’s our duty to act to change it.

AND HERE we face a strange paradox. We are partners in a historic success. And we are partners in a dismal failure.

Perhaps only members of my generation can fully grasp the extend of our success in the transformation of the national consciousness.

Many people ask me: where do I draw my optimism from when the situation becomes very bad, when good people are seized by depression and despair? At such moments I remind myself - and remind the people who listen to me – where we started from. I bring this up again and again for those who did not live through it, and those who have forgotten:

On the morrow of that war, the ‘48 war, when some of us said that there exists a Palestinian people and that we must make peace with them, we were a tiny handful here and in the whole world. We were laughed at. There are no Palestinians, we were told. “There is no such thing as a Palestinian people!” Golda Meir was still asserting much later.

Is there anyone today who denies the existence of the Palestinian people?

We argued that in order to achieve peace, a Palestinian state must come into being. They laughed at us. What? Why? There is Jordan. There is Egypt. There are 22 Arab states. That’s enough!

Today it is a world-wide consensus – two states for two peoples.

We said that we must talk with the enemy, and the enemy was then the PLO. Four cabinet ministers demanded that I should be put on trial for high treason when I met with Yasser Arafat in Beirut during the siege. All four of them later met with Arafat, and the State of Israel signed official treaties with the PLO.

True, the treaties were not implemented and did not lead to peace. But the mutual recognition between Israel and the PLO, between Israel and the Palestinian people, became a fact. That was a revolution, and it cannot be reversed.

Today we are saying: we must talk with Hamas. Hamas is an integral part of the Palestinian reality. And this idea, too, is gaining ground.

What an uproar we caused when we said that Jerusalem must become the capital of the two states! Today almost everybody knows that this must happen, that it will happen.

I have devoted 60 years of my life to this struggle, and it is still in full swing. But we have defeated the idea of a Greater Israel and put forward the alternative of the two states, which has carried conviction in Israel and throughout the world. So much so, that even those in the successive Israeli governments who strongly oppose the idea are now compelled to pretend to support it in order to attract votes.

Think about this when you feel despair. Look at the whole picture, not only at the nearest small part of it.

BUT AS BIG as our victory is our defeat.

It is enough to look at these coming elections: the three big parties talk almost the same language, and not one of them puts forward a plan for peace.

There are small parties which say good and honest things, but at this juncture we simply need more than that. What is lacking is a major political force that is ready to come to power in order to make peace.

It is quite clear that the results of this coming election will be bad – and the only question is whether they will be just bad, or very bad, or even worse.

Why is this happening? There are many reasons, many pretexts. We criticize – and rightly so - many things, the media, the education system, all our successive governments, the President of the United States, all the world.

But I miss one criticism – the criticism of ourselves.

My father used to tell me: if the situation is bad, the first thing to do is to ask yourself if you are alright. So I am asking: Am I alright? Are we alright?

Yes, we have voiced the right ideas. Our ideas have won. But what have we done to realize these ideas in practice, on the political battlefield?

Politics is a matter of power. What have we done to create a progressive political force in Israel? How did it happen that the Left, the camp of peace and progress, has almost been eradicated from the political map? Why don’t we have political power, why don’t we have, for example, even one newspaper, radio or TV station? How did the Israeli Left lose, in the last generation, all its levers of power?

ImageWe in the peace camp include many wonderful men and women, who confront the army every week in the fight against the Wall, who monitor the checkpoints, who refuse to serve in the occupation army, who fight against the occupation in dozens of ways. Many of us, of all ages, take part in these actions.

But while we stand and protest, the settlers rush ahead. Another goat and another dunam (1000 square meters), another hill and another outpost. Sometimes I, too, have the feeling that the dogs bark and the caravan moves on – and I am not content with being the dog. We chase the mosquitoes, but the swamp that produces the mosquitoes gets bigger and bigger.

The swamp is political. Only a political force can drain it. In other words: only a force that can confront the ruling powers, influence the decisions of the government and the Knesset.

That is a historic failure, and we bear the responsibility for it.

IF I may be permitted to voice a birthday wish: the day after the elections I would like us to start thinking about the next elections.

We have to think anew. From the ground up. Examine everything we have done up to now and find out where we went wrong.

Why did we not succeed in convincing enough of the young, of the Oriental Jewish community, of the immigrants from Russia, of the Arab community in Israel, of the moderate religious sector – that there is somebody to talk with, that it is possible to bring about change, that indeed – we can! Why did we not succeed in touching the heart of the young generation that is disgusted by politics – by the politics they know?

What is needed is something completely new, a new act of creation. I would say: we must prepare the ground for an Israeli Obama.

Obama means: to kindle hope where there was no hope before. To demand a change from the foundations up and believe that it is possible to bring about this change. To ignite the enthusiasm of masses of young people for a message that stirs the heart, a message of ending the occupation, of social justice, of caring for the planet. The longing for a different system – secular, just, decent, seeking peace.

The new message must address the mind and the heart, speak to the emotions and not only to the intellect. It must arouse again the idealism that is hiding in many a heart and dare not show its face.

The great obstacle to such an explosion is despair. It is so much easier to despair. So much more comfortable. It doesn’t demand anything. It is easier to say that everything is lost. That they have stolen our state. But pessimism, as is well known, does not give birth to anything, it just leads to internal or external emigration.

I refuse to be pessimistic. In my 85 years I have seen too many unexpected, surprising, amazing, things – both good and bad – for me not to believe in the unexpected. Obama was unexpected, and here it happened before our very eyes. The fall of the Berlin wall was unexpected, and nobody could even have imagined it a moment before it happened. Even the victory of the Greens in the recent municipal election in Tel-Aviv was like that.

I WANT to propose the start of a new endeavor a day after the elections. I would like the best of the intellectuals and the peace activists, the social activists and the fighters for the environment to gather and start thinking together, in order to bring about the Israeli miracle.

Perhaps there should be a grand congress of those who want change, a Sanhedrin of peace and human rights activists, a kind of alternative Knesset.

From the heights of my 85 years I want to call all those to whom our future here is close to the heart, Jews and Arabs, and especially the young, to mobilize for a joint effort to prepare the ground for the big change, for the Other Israel, for a state where it will be fun to live, an Israel we can be proud of.

This is not a game that can be played between existing organizations, but a completely new political creation, that will speak a new language, that will bring a new message.

I believe that this will happen, if not tomorrow then the day after. I wish for myself, and for all of you present in this hall, that we shall see it with our own eyes, that we shall be partners, that we shall be able to say: we have succeeded, we are entrusting the state to good hands.

AND NOW I want to express my heartfelt thanks to all of you, my friends, who have come to mark my birthday with me by exchanging views and debating the issues that are so important to all of us.

Heartfelt thanks to the moderators and the speakers, who have bared the issues for us, to the organizers of this beautiful event, to the members of Gush Shalom who made it possible. Thanks to all of you, who have come from near and afar, and thanks for the good wishes you have showered on me.

Over thirty years ago, a book came out titled "How the Government Breaks the Law", by Jethro K. Lieberman." Even then it was old news and the examples cited seemed small compared to today's chronic law-breakers in the White House and at many federal departments and agencies. Many recent books have been written on the expansive outlaw behavior of George W. Bush and Dick Cheney.

Less attention has been devoted to the explosion of unauthorized actions by the Executive in recent years. What should be the most frequent question by reporters to government officials -- namely, “By what authority are you acting?” – is the rarest of inquiries.

A two part series on Treasury Secretary Henry M. Paulson Jr. in the Washington Post by David Cho in late November brought this point out in a stunningly frank admission by the Corporate bailout czar himself.

Speaking of the takeover of Fannie Mae and Freddie Mac, as well as other megaseizures of failing Wall Street firms, Mr. Paulson expressed these anarchic words: "Even if you don't have the authorities – and frankly I didn't have the authorities for anything – if you take charge, people will follow."

Whew! There you have it! He becomes the law and the law is what he says it is because no one – neither a rubber-stamping President, nor a supine Congress, nor any citizen, deprived of any standing to sue, is going or can do anything about it.

Reporter Cho goes on to write: "Senior government officials said Paulson helped craft rescue programs for financial firms, though he was not sure he had an unquestionable legal basis for the initiatives including the bailouts of the failing investment bank Bear Stearns in March and the wounded insurance giant American International Group (AIG) in September."

Mr. Paulson went further. Playing Congress, he backed the Federal Reserve – already a government within a government funded by banks– to unprecedented unilateral expansion of its powers and its self-made assets. The Post reported that officials from the Treasury and the Fed “never knew whether they had the legal authority to interfere with the market for such derivatives but did so anyway because the opaque trading threatened the wider financial system."

Unauthorized Executive Branch actions tend to be contagious. Noticing that the crisis left Wall Street on its knees and willing to unilaterally assume over $8 trillion in a variety of loan, subsidy and capital obligations, the Bush regime kept making more of its powers all by itself. Why not, they may have been thinking? Look what they've gotten away with in the areas of military and foreign policy actions.

Weekend gigantic corporate bailouts – a more recent one being the $300 billion plus assumption of Citigroup's financial risks – engineered by Citigroup co-boss, Robert Rubin--were very secret affairs.

The more public grab of power was the $700 billion goliath to rescue the casino capitalists on Wall Street which was submitted in only 3 ½ pages of proposed legislation to Congress by Paulson and Ben Bernake, the Fed's chairman in September.

This was too much for the ideologies of House Republicans who beat it on the first round. Even the spineless Democrats thought the requested authority was too much of a blank check. So what happened? Bush told Paulson to give various members of Congress "sweeteners" such as pork and tax breaks for favored lobbyists to get the required votes. Consequently, Paulson was granted staggering discretion to spend the $700 billion when, where and to whom he wanted under whatever conditions or no conditions at all. All in the name of socialism saving capitalism from massive collapse. Ironic.

Mr. Paulson came away from Capitol Hill with Congress in his hip pocket – not exactly what the framers of our Constitution had in mind in 1787.

Thus embolden, Paulson initiated a unilateral, administrative repeal of a Congressional enactment in the tax code – section 382 – to give the banks a huge windfall of about $140 billion. George K. Yin, former chief of staff of the Congressional Joint Committee on Taxation, rejected the legality of the Treasury Department's decision. He told the Post: "I think almost every tax expert would agree that the answer is no. They basically repealed a 22-year-old law that Congress passed [and Reagan signed] as a backdoor way of providing aid to banks."

Section 382 of the Tax code “sharply restricts a company from using the tax losses of a company it acquires to reduce its own tax liability," according to the respected Citizens for Tax Justice. The Treasury's two-page notice generated a brief specialized display of outrage from members of the Tax writing committees in Congress and a hundred national, state and local organizations signed a joint letter to Congress demanding the legislators reverse the Treasury’ unauthorized edict.

So what did the House of Representatives do? It passed, later rejected by the Senate a provision in the auto bailout bill, a provision that would have extended the unauthorized Treasury ruling to the automobile industry!

What is going on here is a revolutionary coup d-etat of our legal system by executive branch diktats.

Is the organized legal profession through their bar associations in challenge mode?

Are law professors churning over this mockery of the legislature and executive branch administrative law?

Are conservative groups – always upset about judicial activism – going into high gear against the new monarchy in and around the White House in downtown Washington, D.C.?

Are all those futurists worried enough about the trillions of debt dollars being piled on our children and grandchildren to protest and act?
Not really.

Obviously, all this is a developing story. Stay tuned, unless you are willing to be turned out.

(NaturalNews) A study of Seventh Day Adventists, published in 2000, showed that several of their lifestyle factors increase longevity and quality of health. The study was conducted among 34,192 self-identified California Adventists. Subjects were asked to complete questionnaires that pinpointed demographics, medical history, diet, physical activity, and a few psycho-social variables. Subjects were evaluated for 12 years in regard to deaths and hospitalizations.

Comparisons were made among the subjects according to several lifestyle choices, and secondly, the Adventist statistics as a whole were compared to the vital statistics of non-Hispanic Californians in general. It was found that there was more variation in longevity between vegetarian Adventists and non-vegetarian Adventists than between Adventists as a whole and non-Adventists. It appears that some of the factors studied are those which can add years to one’s life if adopted.

The factors evaluated for the study were: vegetarianism, body mass index, past smoking (there were no current smokers), exercise, Hormone Replacement Therapy (HRT) in women, and eating of nuts. A vegetarian diet was defined as meat consumption, never or less than once per month; and semi-vegetarian as eating of meats more often than vegetarians, but less than once per week. All others are non-vegetarians. Few Adventist vegetarians are vegan. Meat was identified as beef (hamburger, steak, other beef, or veal), pork, poultry, and fish. Nut consumption was included in these analyses because of previously published evidence showing protective associations between nut consumption and deaths due to coronary heart disease. Unfortunately, the article did not define what was considered a nut for the purposes of this study.

Generally it was found that among the non-Hispanic Californian population, those identified as Seventh Day Adventists lived longer, on the average of 7.3 extra years for men, and 4.42 more years for women.
Among the Adventist population itself, it was found that high physical activity, frequent consumption of nuts, vegetarian status, and medium body mass index each result in an approximate 1.5- to 2.5-years gain in life expectancy. Hypertension accounts for the loss of 4.2 and 3.2 years and diabetes for the loss of 4.6 and 8.6 years in men and women, respectively.

The effects ascribed to "non-vegetarian status" are probably related to the greater intake of foods high in saturated fat and the lower intake of foods higher in unsaturated fat, fiber, antioxidant vitamins, and other phytochemicals. This may affect mortality due to cardiovascular causes and cancer. Similarly, those who consume more nuts have been shown to have 35% to 50% lower rates of coronary events in other studies. This is probably due in part to the blood cholesterol–lowering effects of nuts, and perhaps to their unusually high content of antioxidant vitamin E. Increased physical activity is associated with important reductions in the relative risks of coronary events, stroke, and cancers of the breast and colon.

The mechanisms are not entirely understood, but probably include effects on blood lipid levels, sex hormones in women, blood insulin level, the immune system, obesity and on the reduced risk of diabetes and hypertension. Whatever the mechanisms, it seems apparent that half of Adventist men and women are losing more than 4 years of life, apparently due to their less than optimal behavioral choices which are also not in adherence to their faith’s dietary guidelines.

Of the 5193 observed deaths, 1373 (26.4%) were ascribed to coronary heart disease, 1074 (20.7%) to cancer, and 531 (10.2%) to stroke. Almost half died of other causes which were not listed.

The subjects of this California study enjoying the longest lives were the vegetarians. Other studies have shown health benefits from vegetarian diets, so one conclusion is that it is better for one’s heart to eat less meat. A UK study found, for example, in comparison with regular meat eaters, mortality from coronary heart disease was 20% lower in occasional meat eaters, 34% lower in people who ate fish but not meat, 34% lower in lacto-ovo-vegetarians, and 26% lower in vegans. There were no significant differences between vegetarians and non-vegetarians in mortality from cerebrovascular disease, stomach cancer, colorectal cancer, lung cancer, breast cancer, prostate cancer, or all other causes combined.

A further note on the Seventh Day Adventist (SDA) philosophy: The SDA organization is evidently very concerned with health in general. Their university at Loma Linda, California, does much in the way of medical research. It is possible that this concern filters down into its followers’ life choices and further increases their longevity. Smoking and alcohol consumption are discouraged. In other ways, though, SDA followers are like the rest of their neighbors. For example, they follow the requirements of their state in regard to vaccinations for their children. The author found no evidence that SDA parents complained against the inoculations provided by SDA schools, nor sought waivers for their children to opt out of vaccinations.

The results of this study and others do strongly suggest that behavioral choices influence the expected age at death by several years, even as much as a decade. The study shows that commonly prescribed recommendations to improve diet, increase physical activity, stop smoking, and reduce body weight are relevant to increasing life expectancy and quality of life. The addition of nuts to the diet is a less prescribed habit that seems to provide increased health benefits as well.

ImageAnd doubt not there will be future footwear tossers. At every public function, every so called speaking engagement, every shopping mall opening; sandals and sneakers and boots and broughams and pumps and wing tips and stilettos and slippers and especially loafers will rain down on the 43rd President of the United States like taunts upon the Yankees right fielder from the bleachers of Fenway. A pelting that should be sufficient to discourage him from visiting the Netherlands for pretty much ever.

You won't even have to actually propel anything to knock him off stride. It'll be enough to disrupt any security detail to swiftly bend down and take off one shoe, quickly rise with it, then leisurely remove a stone or pick some gum off the tongue or restring the laces. Of course, if certain liberal factions get their way, this will just be the first in a long line of items being chucked at the W, in the hopes that eventually somebody throws the book at him and it sticks.

More Shoes Of Symbolic Justice Against Those Who Abuse Power Etc.

I have been obsessed, of late, with the video image of Bush and Muntazer al-Zaidi, the Iraqi journalist-shoe thrower. In this time when actual justice is dead, the only kind of redress that remains in the hearts of free people of good will is the symbolic kind.  There is now a call across the Muslim world for a "shoe jihad" against President Bush (I kid you not). 

Al-Zaidi received summary Amerikan thug-justice for his spontaneous act of righteousness and retribution against the biggest criminal and mass murder since Pol Pot.  He was severely beaten, his arm was broken, and he was whisked off to a hospital within the Green Zone. I find it hard to believe his fellow journalists administered such a beating. 

His recent recantations smack of evident "reprogramming."  The punishment for killing over a million of your fellow humans is a cushy pension, a presidential library and retirement to a fortified compound in a South American country, whereas one who throws his shoes at such a criminal and calls him a dog, faces up to 15 years in prison. 

I fervently hope and pray that this idea catches on and, for the rest of his life, Bush will have to remain eternally vigilant for unexpected, incoming, high velocity footwear. I for one pledge, that if I ever come near the man, my shoes will be off to him, no matter what the personal consequences.  That, for my mind, would be only partial justice.

WASHINGTON, D.C. – Congressman Jerrold Nadler (NY-08), Chairman of the Judiciary Subcommittee on the Constitution, Civil Rights and Civil Liberties, today urged Attorney General Michael Mukasey to appoint an independent counsel to investigate Vice President Richard Cheney, former Secretary of Defense Donald Rumsfeld, and other senior administration officials for violations of the law relating to the torture of prisoners in U.S. custody.

In a recent interviewed with Jonathan Karl of ABC News, Vice President Cheney said of the waterboarding of Khalid Sheikh Mohammed, “I was aware of the program, certainly, and involved in helping get the process cleared ... And I supported it.”

Khalid Sheikh Mohammed was subjected to waterboarding.

Congressman Nadler wrote to the Attorney General, “The Vice President’s public admission that he was ‘aware of the program, certainly, and involved in helping get the process cleared’ is deeply disturbing. It implicates the Vice President in activity which appears to have been a direct violation of our criminal laws against the use of torture.” Congressman Nadler continued, “Waterboarding has always, except in self serving legal memos and statements by the Bush Administration, been regarded as torture. In 1948, the United States tried, convicted, and hanged Japanese generals for waterboarding Allied prisoners.”

“This shocking admission by the Vice President demands at a minimum a federal investigation and, if necessary, the pursuit of criminal charges,” said Congressman Nadler. “No one is above the law and, if the Vice President admits he broke the law, then he must be held responsible.”

Also, a newly released bipartisan Senate Armed Services Committee report found that “Secretary of Defense Donald Rumsfeld’s authorization of aggressive interrogation techniques for use at Guantanamo Bay was a direct cause of detainee abuse there.” “If that doesn’t demand an independent counsel, I don’t know what does,” said Congressman Nadler.

Congressman Nadler has been an active critic of executive abuses for many years. He has held numerous hearings on the Bush Administration’s violations of our civil liberties, including hearings on the issue of torture and extraordinary rendition.

Dear Mr. Attorney General:

I am writing to urge you to appoint an independent counsel to investigate Vice President Richard Cheney, former Secretary of Defense Donald Rumsfeld, and other senior administration officials, for violations of the law relating to the torture of prisoners in U.S. custody, and, if appropriate, to pursue criminal charges.

As you may know, Vice President Cheney was recently interviewed by Jonathan Karl of ABC News.[1] In that interview, the Vice President engaged in the following exchange:

KARL: Did you authorize the tactics that were used against Khalid Sheikh Mohammed?

CHENEY: I was aware of the program, certainly, and involved in helping get the process cleared, as the agency in effect came in and wanted to know what they could and couldn't do. And they talked to me, as well as others, to explain what they wanted to do. And I supported it.[2]

As we know, those interrogation techniques included so-called “waterboarding.” There is no question that waterboarding is an egregious form of torture. Waterboarding has always, except in self serving legal memos and statements by the Bush Administration, been regarded as torture. In 1948, the United States tried, convicted, and hanged Japanese generals for waterboarding Allied prisoners.

As you know, federal law makes it a crime to commit torture, or to engage in a conspiracy to commit torture.[3] The statute provides for a prison term of up to 20 years, or, if death results from the torture, a sentence of death.[4]

The Subcommittee on the Constitution, Civil Rights, and Civil Liberties received compelling testimony from Malcolm Nance, a former instructor at the U.S. Navy Survival, Evasion, Resistance and Escape School (SERE). As part of SEER training, instructors employed “dramatic and highly kinetic coercive interrogation methods through hands-on, live demonstrations and a simulated captive environment, which inoculated our students to the experience of a high-intensity stress and duress.”[5]

Mr. Nance went on to describe one of the techniques:

Some of these coercive physical techniques have been identified in the media as enhanced interrogation techniques. The most severe of those employed by SERE was waterboarding . . . . Most media representations or recreations of the waterboarding are inaccurate, amateurish, and dangerous improvisations which do not capture the true intensity of the act. Contrary to popular opinion, it is not a simulation of drowning. It is drowning. In my case, the technique was so fast and professional that I didn’t know what was happening until the water entered my nose and throat. It then pushes down into the trachea and starts to process a respiratory degradation. It is an overwhelming experience that induces horror, triggers a frantic survival instinct. As the event unfolded, I was fully conscious of what was happening: I was being tortured.[6]

The Vice President’s public admission that he was “aware of the program, certainly, and involved in helping get the process cleared” is deeply disturbing. It implicates the Vice President in this activity which appears to have been a direct violation of our criminal laws against the use of torture.

Similarly, a recent report issued by the Senate Armed Services Committee found that “Secretary of Defense Donald Rumsfeld’s authorization of aggressive interrogation techniques for use at Guantanamo Bay was a direct cause of detainee abuse there.”[7] Additional evidence shows that other top officials also were involved in authorizing similar activities.

In view of the fact that this policy was set and approved at the very highest level of the administration, it is impossible for the Department of Justice to investigate the matter without, at the very least, the appearance of a conflict of interest. It is important that the American people have confidence that their leaders are subject to the rule of law, and that those charged with enforcing the law do so without fear or favor. In this case, the Vice President of the United States has admitted to engaging in activities for which this nation has tried and executed individuals from other nations, most notably the major Japanese war criminals following World War II. Such a serious admission cannot go uninvestigated and, because it is the Vice President, his conduct cannot credibly be investigated and evaluated by anyone in the executive branch.

For these reasons, I urge you to appoint an independent counsel to investigate the actions of Vice President Richard Cheney, former Secretary of Defense Donald Rumsfeld and other senior administration officials as they relate to the torture or mistreatment of prisoners in U.S. custody.

Here’s a detailed call for the stimulus plan to include a program that will support artists and writers.

Programs that paid thousands of artists and writers comprised one of the most creative aspects of the New Deal. Thousands received relatively small outlays of funds for their work, and the nation’s artistic heritage was greatly enhanced. The same kind of initiative is needed today.

Congress needs to recommend that the government spend one percent of the stimulus plan on arts and culture (that would mean $6 billion if the final package is $600 billion), building on the New Deal’s Federal Art Project and the Federal Writers Project. Below, we offer 11 ideas on how the money could be spent. We also support ideas that link different parts of the stimulus package; for example, new murals and sculptures could adorn the new schools that will be built.

The Works Progress Administration (WPA) was created in 1935 to bring jobs to those who had become unemployed or underemployed during the Great Depression. Since artists and writers were also hit by the economic hard times, two divisions of the WPA were assigned the task of creating suitable jobs for such people — jobs that would not only take advantage of these individuals' talents, but would also serve to enrich America's cultural heritage and embellish public spaces. The grouping of the largest of these programs is collectively known as the “Federal Project Number One.” Included in this collective were the Federal Writers’ Project, the Historical Records Survey, the Federal Theatre Project, the Federal Music Project, and the Federal Art Project. All of these programs were divisions of the Works Progress Administration. Out of the approximately $4.8 billion allocated to the Works Progress Administration, Congress permitted $27 million to fund the Federal Project Number One projects.

The Federal Art Project, along with several other WPA-backed programs, created well over 5,000 jobs for American artists. These artists created over 2,500 murals, over 17,700 sculptures, 108,000 paintings, and 240,000 prints. The project's legacy still lives on, since it supported artists like Jackson Pollock, Arshile Gorky, and many other abstract expressionists whose work helped shift the most dynamic center of the art world to shift from its traditional location in Europe to where it now resides, in the largest cities of the United States.

The Federal Writers' Project created over 6,600 jobs for writers, editors, researchers, and many others who exemplified a given level of literary expertise. Established on July 27, 1935 by President Franklin D. Roosevelt, the Federal Writers' Project (FWP) operated under journalist and theatrical producer Henry Alsberg, and later John D. Newsome, compiling local histories, oral histories, ethnographies, children's books and other works. These writers created over 1,200 books and pamphlets, and they produced some of the first U.S. guides for states, major cities, and roadways. In addition, the FWP was responsible for recording folklore, oral histories, and, most notably, the 2,300 plus first-person accounts of slavery that now exist as a collection in the Library of Congress. As with the Federal Art Project, the FWP's contributions to American literature were both significant and long-lasting, giving authors like Saul Bellow, Zora Neale Hurston, John Steinbeck, Sterling Brown, and many others the opportunity to continue their work in a time of difficult economic circumstances.

Here are some of the ways the funds could be used:

1. National Endowment for the Arts (NEA) and National Endowment for the Humanities (NEH): Increase funding for the NEA and NEH. Increase the staff at both agencies. Maintain many of the new NEA projects started by Dana Gioia, for example: The Big Read and Operation Homecoming.

2. Archives: Support the preservation of literary archives across the country. Many collections need to interface with modern technology; staff needs to be hired at various institutions. We don't want to lose our past.

3. A Secretary-level post for Culture/Arts: We support the idea of Bill Ivey, former NEA Chair under President Bill Clinton, and head of the arts/culture Obama Transition Team for a Secretary level post for Culture/Arts. Indeed, the United States and Germany are the only wealthy nations without a Minister or Secretary of Culture. Ivey’s initiative involves the refocus and revitalization of the extant Committee on the Arts and the Humanities, which could be a better interim and/or long-term mechanism for new arts and culture policies.

4. Arts Education: Educational institutions, especially public school systems in low-income and underserved communities, would hire artists and writers. Funds would be made available for artist and writer-in-residence positions.

5. Arts in Public Spaces: Support for the arts in public places; especially parks, metro stations, airports, etc. Every major city and community should have access to concert series and readings in their major parks, especially in times of economic hardship.

6. Workplace: Funds to bring poets and writers into the workplace. Build literacy by enlivening the reading public. Contemporary writers would bring their work to the people. Readings could be held around noon at workplaces.

7. Document history: Document U.S. literary and cultural history on a city, state and national level. This would be similar to the old WPA program. Interview major writers and painters. It could be done by doing a series of films.

8. American Artists Overseas: Money should be set aside to send American artists overseas for three-six month periods, with an emphasis on countries where the United States has been at odds. They would serve as cultural ambassadors and give lectures and performances. They would also collaborate with artists of the host country to produce cultural events.

9. Fellowships/Scholarships awarded to working/low income individuals who wish to enroll in creative writing programs: Many older people wish to return to school to pursue careers in the arts but have no money for tuition.

10. Black colleges: Money should be set aside to develop creative writing programs at historically black colleges. No creative writing program exists at any black college. This would create teaching jobs for many African American authors.

11. Libraries: We should support library infrastructure and provide writer and artist-in-residence programs for our libraries, especially those in low-income communities. Our nation's libraries are public treasures and many have been closed in recent years. Money is needed to keep our libraries open and alive.
